These Terms and Conditions ("Terms", "Agreement") govern your use of the driver services offered by Vahan Chalak ("we", "us", "our") operated by Vikram Singh. By using our services, you agree to comply with and be bound by these Terms.
1. Interpretation and Definitions
Interpretation: Capitalized words have meanings defined under these conditions. These definitions apply whether the words appear in singular or plural.
Definitions:
- Business: Refers to Vahan Chalak, a vehicle driver service operated by Vikram Singh.
- Client: The individual or organization using the driver services.
- Service: The driver-on-demand services offered through our platform.
- Website: Our official site: https://www.vahanchalak.com.
2. Payment Terms
Clients agree to pay the full service amount in advance or as mutually agreed. Pricing details are available on our website or communicated directly. Non-payment will result in service denial.
3. Cancellation and Refund Policy
All bookings are final. Once confirmed, no cancellations or refunds will be issued. Clients are advised to review their booking carefully before confirming.
4. Client Responsibilities
- Clients must ensure their vehicle is insured and roadworthy.
- Clients must include driver insurance coverage in their policy if needed.
- Clients are responsible for informing drivers of any specific requirements or safety instructions.
- Clients must treat all drivers with respect and avoid misconduct.
5. Service Limitations and Liability
We strive to offer a professional service but do not guarantee availability, punctuality, or uninterrupted service. We are not liable for:
- Accidents, damages, injuries, or delays during service use.
- Third-party driver conduct or actions beyond our control.
- Loss or damage to personal property during transportation.
6. Termination of Service
We reserve the right to suspend or terminate service to any client who violates our Terms, engages in misconduct, or provides false or misleading information.
7. Force Majeure
We are not responsible for delays or service failures caused by events beyond our control, including but not limited to natural disasters, strikes, roadblocks, or weather disruptions.
8. Governing Law
These Terms are governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts located in Jaipur, Rajasthan.
9. Maximum Working Hours (Per Day)
Maximum permissible driver duty in one day is 12 hours.
• Driving beyond 12 hours is strictly prohibited for safety reasons.
• If service exceeds 12 hours, additional hours may be refused or rescheduled.
10. Driver Food & Meal Policy (Mandatory Compliance)
Food support is required only if applicable based on trip timing.
If the customer is providing food:
• Food must be fresh, hygienic, and safe for health
• Junk, stale, or unhealthy food must be avoided
If morning meal is applicable:
• Must be provided before 12:00 PM (Noon)
If night meal is applicable:
• Must be provided before 10:00 PM
11. Meal Cost Charge (If Food is Not Provided)
If the customer does not provide food when applicable:
• A fixed food allowance of ₹200 per meal will be charged
• This applies separately for morning and night meals
Example:
• If both meals are not provided → ₹200 + ₹200 = ₹400
This charge is compulsory and non-negotiable.
12. Driver Rest & Tea Break Policy
For safety and health:
• Driver is allowed a short tea / rest break after every 100 km of driving
• Break duration will be reasonable and within trip schedule
13. Multi-Day Trips / Outstation Night Stay Conditions
If the trip involves night halt or multiple days:
The customer must provide a safe and comfortable stay that includes:
• Proper sleeping arrangement (bed / mattress / clean space)
• Suitable weather comfort (fan in summer, blanket in winter, etc.)
• Access to toilet & washroom
• Clean and safe accommodation
Driver is strictly prohibited from sleeping inside the car.
If proper stay is not arranged:
• Customer must pay accommodation cost as applicable
14. Behavior & Safety Responsibility
Customer must ensure:
• Respectful and professional conduct with the driver
• No unsafe or unlawful driving requests
• No forceful overtime driving
• No driving in intoxicated or unsafe environments
The driver holds the right to refuse unsafe situations.
15. Drop-Only Ride Assistance Condition
In drop-ride bookings:
• Customer must assist the driver in reaching a
nearby bus stop, railway station, or suitable return point
• If any transport or travel charges occur,
they must be paid by the customer only
This ensures the driver can return safely.
16. Waiting Time & Trip Duration
• Waiting time during the service is counted as part of the total duty hours.
• Billing is based on time duration as per selected package
• For Drop-Only Ride Type: After the driver reaches the customer pickup location, a maximum free waiting period of 30 minutes is allowed. After 30 minutes, additional waiting charges will be applicable at the rate of ₹100 per hour, calculated separately from the package charges.
17. No Liability for Lost or Personal Belongings
Customers are responsible for their belongings inside the vehicle.
18. Service Usage Conduct
The driver must not be forced to:
• Sleep in the vehicle
• Drive continuously without break
• Operate under stress or unsafe conditions
Failure to follow guidelines may result in service termination.
19. Updates to Terms
We may update these Terms at any time. Material changes will be notified via our website. Continued use of the service implies acceptance of the updated Terms.
